The Trade Ministry recently issued Regulation No. 14/M-DAG/PER/3/2016 (Amendment), which is an amendment of Regulation No. 77/M-DAG/PER/12/2013 on Simultaneous Issuance of Business License and Company Registration Certificates for Trading Companies (Regulation). The Regulation and its Amendment allow newly established companies to arrange the Trade Business License (SIUP) and the Company Registration Certificate (TDP) at one time. The Amendment now further simplifies the procedures already regulated by the Regulation.
Application of Trade Business License (SIUP) and Company Registration Certificate (TDP)
The Amendment has changed the application form for securing the Trade Business License (SIUP) and Company Registration Certificate (TDP). The application must be submitted by a manager, person in charge or a third party to the related officer in the one stop shop in the related area of the company.
Issuance of Trade Business License (SIUP) and Company Registration Certificate (TDP)
Upon receipt of a complete and correct application, the related authority will publish the Trade Business License (SIUP) and Company Registration Certificate (TDP) within 2 working days from the date of receipt of the application. Both licenses shall be issued separately in accordance with the format based on the specific Trade Regulation for each licenses.
In case the application is not considered complete and correct by the related authority, the application will be rejected. In such case the authority will issue a letter of rejection within 1 working day as of the date of receipt of application. In such case the application can reapply for the issuance of the licenses. The Amendment provides makes it possible to issue the license digitally through the online system provided by the Ministry of Trade. Previously the digital publishing was not regulated in the Regulation.
Prior to the Amendment, the approval or refusal of Trade Business License (SIUP) and Company Registration Certificate (TDP) applications was sent to applicants within three working days as of the receipt of application.
