The Indonesian government took another major step forward in becoming the majority stakeholder (through state-owned mining holding company Indonesia Asahan Aluminium, or Inalum) of mining giant Freeport Indonesia that operates the lucrative Grasberg mine in Papua.
After the much publicized signing by the Indonesian government and US mining giant Freeport McMoRan of the Heads of Agreement regarding the sale of a stake in Freeport Indonesia (the operator of the lucrative Grasberg mine in Papua) on 12 July 2018, we have not heard much about the deal that is valued at USD $3.85 billion.

The Indonesian government and US mining giant Freeport-McMoRan Copper & Gold Inc are entering the final stage of the divestment process after both sides signed the Head of Agreement on Thursday (12/07). The agreement means that state-owned mining company Indonesia Asahan Aluminum (Inalum) will obtain a 51.23 percent stake in Freeport Indonesia via a series of complex deals worth USD $3.85 billion.
Indonesia's Energy and Mineral Resources Ministry stated that it will remain committed to the agreement that was made between Freeport Indonesia and the central government of Indonesia on 29 August 2017. However, although parent company Freeport-McMoran agreed to divest a majority stake in its Indonesian unit (Freeport Indonesia) in those negotiations, the exact divestment valuation is yet to be agreed upon.
Arizona-based mining giant Freeport-McMoRan finally reached an agreement with the Indonesian government regarding the extension of the permit to operate the Grasberg mine, the world's largest gold mine and third-largest copper mine, in Papua. Ignasius Jonan, Indonesian Energy and Mineral Resources Minister, said Freeport can per direct apply for a 10-year permit extension to mine at Grasberg beyond the year 2021. Afterwards, it can apply once more for a 10-year extension.
The management of gold and copper miner Freeport Indonesia is optimistic that negotiations with the central government will be completed before the Idul Fitri celebrations in the last week of June 2017. If an agreement is reached, then the case will not require arbitration. Both parties are negotiating over a contract dispute that also prompted the subsidiary of the United States-based mining giant Freeport-McMoRan to wind down operations (and fire staff) at its Grasberg mine in Papua.
The dispute between Freeport Indonesia and the Indonesian government may escalate now the former said it considers to seek international arbitration over the government's alleged breaching and violation of the existing Contract of Work (CoW) between both sides. Ever since the passing of Law No. 4/2009 on Mineral and Coal Mining (New Mining Law) there has been a high degree of uncertainty in Indonesia's mining sector.
Indonesian newspaper Bisnis Indonesia printed an interesting interview with Vice President Jusuf Kalla on Wednesday (19/10). Kalla is one of the few political veterans of Indonesia, having been born during the Japanese occupancy of the Dutch East Indies, before Indonesia existed. He was VP under Susilo Bambang Yudhoyono (2004-2009), leader of Golkar, Coordinating Minister for People's Welfare (2001-2004), and Minister of Trade & Industry (1999-2000). Copper and gold miner Newmont Nusa Tenggara, the local unit of US-based mining giant Newmont Mining Corp, requested for a new recommendation letter from Indonesia's Energy and Mineral Resources Ministry. This recommendation letter is required to extend Newmont's six-month copper concentrate export permit at the nation's Trade Ministry. This would be the fourth time Newmont's export permit is extended. Whether Indonesia's Energy and Mineral Resources Ministry issues the export recommendation letter depends on progress made with the construction of smelting facilities.

Indonesian Minister of Energy and Mineral Resources Jero Wacik regrets to see Newmont Nusa Tenggara, one of Indonesia largest copper miners, file for international arbitration due to Indonesia’s export ban stipulated by Law 4/2009 on Mineral and Coal Mining (Minerba). This new law includes the ban on exports of ore concentrates from Southeast Asia’s largest economy. Instead, Indonesian miners are required to process the minerals domestically first. The ban was implemented on 12 January 2014.
Newmont Nusa Tenggara (NNT), one of Indonesia’s largest copper miners, said on Thursday (05/06) that it sees no other option than to declare a force majeure at its Batu Hijau copper mine in Sumbawa (West Nusa Tenggara) due to the export tax dispute with the Indonesian government. President Director of NNT Martiono Hadianto also informed the Indonesian Ministry of Energy and Mineral Resources that 80 percent of the company’s workers will be put on leave with reduced salaries.
Freeport Indonesia stated that the company's production of copper concentrate plunged since the Indonesian government implemented the ban on exports of unprocessed minerals on 12 January 2014. Currently, Freeport only produces to supply Smelting Gresik, Indonesia's first copper smelter and refinery. As such, Freeport only operates at 45 percent of production capacity regarding copper concentrate. According to Freeport Indonesia's spokeswoman Daisy Primayanti, production of copper concentrate fell to 3,150 tons per day.
On Sunday (12/01), one of the most important new laws in the recent history of Indonesia came in force. Mining Law Nr.4/2009, which prohibits the export of unprocessed minerals from Southeast Asia's largest economy, was implemented. However, it was not implemented in its original form. The president of Indonesia, Susilo Bambang Yudhoyono, signed a last-minute regulation which softens the impact of the new law by allowing mining companies to continue exports of copper, manganese, zinc, lead and iron ore concentrate until 2017.
There has been quite some commotion regarding Indonesia's mining industry in recent years. The New Mining Law of 2009 implied a number of rigorous changes that are controversial up to the present day. The law was designed to increase Indonesia's profits from its own abundant natural resources, a sector in which many foreign companies are active. For foreigners the new law contains a number of protectionist measures that make Indonesia's mining industry less appealing.
